In our office we track our PPH cases pretty closely. Through most of 2014 and most of 2015, we had been seeing delays averaging six months. It was taking the USPTO an average of six months to get around to deciding whether to grant or dismiss a PPH petition. I blogged about this problem here and here and here and here and here. I faxed a letter to Director Lee about this on April 24. One or two recent data points suggest that maybe USPTO is being less slow about this.
As you can see from the graph, the most recent two PPH grants that we received (just within the last two weeks) were grants of petitions filed less than four months earlier. For quite a long time the USPTO had pretty consistently been taking six months to get around to examining a PPH petition. Four is a smaller number than six. So maybe things are getting better.
I spoke to the Office of Petitions last week about a PPH petition pending for 3 months. I was told to expect the decision in mid-October, so the Office of Petitions seems to still be operating on a 6-month time frame in that case.
