One caveat for those of you filing electronically using USPTO’s TEAS forms — These forms know that there are certain filing deadlines and will not permit filing after those deadlines. The forms are also programmed to coincide with the USPTO policy concerning the handling of deadlines, namely, when the filing deadline falls on a Saturday, Sunday or a Federal holiday within the District of Columbia, TEAS “extends the deadline” to the next succeeding secular or business day. The forms are programmed well in advance to recognize all Saturdays, Sundays and Federal holidays in any given year.
However, the forms can’t be programmed in advance to anticipate an unexpected closure of the USPTO for snow. Even though the USPTO will accept March 3 filings on March 4, TEAS won’t, because it will still be operating under its “normal” schedule for all deadlines. If you are planning to take advantage of the extra day, be prepared to file via post office/certificate of mailing, the old fashioned way, unless the USPTO has recently reprogrammed its software.
